My parents are elderly and have opted (against all advise) to provide my 50 yr. alcoholic brother with living arrangements with them in their home. He has stated that when they die he will remain in the home. The home is in a trust and must be sold when both my parents pass. unless you have legal power of attorney over your parents estate, it's nothing you can do, as far as when the sad day comes that they do pass. since the property is in a trust which is legally binding, your brother will have no choice but to vacate the premises. now if your parent's become unable to make everyday decision's on there on, then, with there blessing, be able, with an attorney, obtain legal power of attorney, at which point then, and only then will you have the legal power to evict you brother. hope this helps.
When the time comes, you sell the house as instructed in the trust and evict your brother so that they new owners can move in.
how will they get him out? local police/sheriffs department, or if has a gun, there's always the SWAT team you can call.
call the sherrifs department, and if he says no they will hopefully haul his *** away. same thing would happen if you don't pay rent in a apartment... EVICTION
