I'm a Canadian living overseas and I want to divorce my alcoholic husband of 3 years. We have a 5 month old baby and I want full custody and to bring the baby back to Canada with me for good. How can I prove during the divorce that my husband is an alcoholic and that my baby should not live with him, even part time. He's very good at hiding his affliction and I would have a very hard time finding eye-witnesses to his drunkeness. They will have him take a urine test to see if there is any alcohol in his system.
You should go speak to an attorney that practices in the location where you will get your divorce. An attorney practicing in that location will be in the best position to advise you on what evidence the courts will or won't allow to be presented. He/she can also let you know if there are any requirements that you have to meet to be able to file for divorce (there may be residency requirements, etc.) He/she may charge a consultation fee, but keeping your child would be well worth the fee.

It's not very often you will see a judge award one parent full custody of the children.... full physical custody yes. In order to show the judge hes an alcoholic you are going to need PROOF of such a thing. Getting as many police records as possible for DWI, records if there was ever domestic abuse in your home related to drunkeness, jobs he was fired from because of drunkeness..... if you do not have proof, then a judge will ask how YOU are an expert on drunks.
Do you own a video camera or small tape recorder? If so hide it and when you think it is a prime drunkin moment try to somehow vidoe a little or maybe just record conversations or anything that can help prove it. Maybe also somehow show the date and time. I am sure they will say you can alter the dates and times but if it is video the diffrent clothes ot scenes can show they were done at diffrent times. Try to get any creditable people that can stand up for and you can trust to maybe be around without his knowledge. A video or written statement usually will work. Someone with a law degree would be better to ask. If you have an attorney ask them, if you don't you should get one. You can start with any DUI's he has gotten, records of missed days of work that sort of thing and it might be hard but try to find a witness or two, maybe at his favorite bar because you will need to build a case against him, the more evidence you have the better your case will be. get a ';baby cam';, its also called a ';nanny cam';....its a video surveillance camera that you can either put in a toy, or comes in the form of a childs toy, its used to film babysitters to make sure the kids aren't being abused, or to see how they are treated when the parents leave the child in someone elses care....Get it on Film!!!
